The Occupational Safety and Health Act was enacted in 1970 “to assure so far as possible every working man and woman in the nation safe and healthful working conditions and to preserve our human resources.” 29 U.S.C. 651(b). The law created the Federal Occupational Safety and Health Administration (”OSHA”) and authorized state governments to pass OSHA plans to enforce occupational safety and health issues within each state.
